Jarvis Sues Over $150 SRA Fee

SACRAMENTO – The Howard Jarvis Taxpayers Association has kept its promise and filed a lawsuit in Sacramento Superior Court to get a declaration as to whether the fee is valid. It also seeks refunds for those who have already paid the SRA fee and filed a claim with the state.
The Association says the $150 annual State Responsibility Fee is actually an illegal tax. They say to be legal it would have to go on the ballot and be passed by a 2/3 majority of the voters. The state is in the process of billing owners of 825,000 rural properties
Jon Coupal, the president of the Association called it a budget gimmick. Eleven other plaintiff ’s joined the Association in the suit in an attempt to have it classified as a class action suit and names Cal Fire and the State Board of Equalization as defendants. Cal Fire has the responsibility of determining who will pay the annual Fee and The Board of Equalization is responsible for collecting it. The money, if collected, is supposed to be used for fire prevention, not fire suppression.
Until the court rules otherwise it is suggested that you pay the bill and appeal it.
